MM CLEANING NI – SERVICE AGREEMENT
This Service Agreement is made between MM Cleaning NI (the "Business") and the customer submitting this form (the "Customer"), on the date this form is submitted. The Business contracts with the Customer to provide the cleaning services described in this Agreement and may use suitably vetted Cleaners to perform those services on its behalf.
- The Business shall provide the Customer with an appropriate Cleaner for the services required.
- The Cleaner remains responsible to the Customer for the performance of the Services.
Booking, Deposit, Cancellation and Termination
- To secure your first cleaning appointment, a £10.00 deposit is required when booking. This deposit will be deducted from the cost of your first clean.
- If you change your mind and cancel your agreement within 14 days of signing up, your £10.00 deposit will be refunded in full. If you cancel after the 14-day cooling-off period has ended, the £10.00 deposit will not be refunded.
- If you ask us to start providing cleaning services during the 14-day cooling-off period and then cancel, we may deduct the cost of any services already provided before issuing any refund.
- Any change to the day or time of a clean must be agreed with the Cleaner directly. To cancel a clean, the Customer must text 07441 475862 (see clause 8). The Cleaner has no authority to vary the scope, price or other terms of this Agreement on behalf of the Business.
- Either the Business or the Customer may end this Agreement by giving 48 hours written notice. A text message to 07441 475862 or an email to info@mmcleaningni.com counts as written notice.
- The Customer may cancel a booked clean by texting 07441 475862 at least 48 hours before the clean is due to start. If less than 48 hours' notice is given, the Business may charge a cancellation fee at its discretion to cover any costs or losses arising from the cancellation.
- The Customer has the right to cancel this Agreement without giving any reason within 14 calendar days of the date on which this Agreement is entered into.
- To exercise the right to cancel, the Customer must notify the Business of their decision to cancel by providing a clear written statement by email, post, or any other durable medium.
- If the Customer cancels this Agreement within the cancellation period, the Business will reimburse any payments received from the Customer within 14 days of receiving the cancellation notice, subject to the provisions below.
- Any cleaning services completed before the Agreement ends must be paid for.
- Upon termination of this Agreement, the Business shall cease providing Services to the Customer. The Customer shall not be entitled to receive any further Services through the Business unless otherwise agreed in writing.
- If the Customer wishes to hire a Cleaner directly who was introduced to you by the Business, you must obtain the Business's written agreement and pay a £100 introduction fee before any direct arrangement begins.
- This fee does not apply where you can show that you already knew and engaged the Cleaner before they were introduced by the Business.
- Any notice must be given in writing and sent by text message to 07441 475862, by email to info@mmcleaningni.com, by hand**,** or by post to the latest address provided.
Payment
- The Customer shall pay the Cleaner directly for the Services on the same day the service is carried out. If the Customer fails to make payment to the Cleaner on the day stated above, the Business reserves the right to withhold any future cleans.
- The Business will endeavour to supply the same Cleaner on every clean, subject to availability.
- If the Cleaner is unavailable, the Cleaner will arrange another suitable and vetted Cleaner to carry out the service. The Customer may refuse a replacement on reasonable grounds relating to safety, security or suitability.
- If the Customer refuses the Cleaner's substitute, it is the responsibility of the Business to provide another suitably vetted Cleaner to perform the Services.
Complaints
- Any Complaint must be notified promptly to the Business using the contact details in this Agreement, and the Customer must give the Business a reasonable opportunity to inspect and, where appropriate, re-perform the affected Services.
Any other Business
- The Customer must provide safe access to the property at the agreed time, make us aware of any known hazards, secure any pets and advise of any delicate or high-value items.
- The Business may refuse or stop the service if the property is considered unsafe.
- Nothing in this Agreement limits liability for death, personal injury, fraud, or anything else that cannot legally be excluded. Other than this, the Business's total liability under this Agreement will not exceed £1,000,000 unless the law requires otherwise.
- This Agreement contains the entire agreement between the parties and replaces any previous discussions or agreements. Any changes must be agreed in writing by both parties.
- If either party delays enforcing a right, this does not mean they have waived that right. If any part of this Agreement is found to be invalid, the rest will continue to apply. This Agreement is governed by the laws of Northern Ireland, and any disputes will be dealt with by the courts of Northern Ireland, subject to any legal rights a consumer may have.
- The Customer acknowledges and agrees that acceptance of these Terms and Conditions by electronic means, including by ticking an acceptance box on the Business's website, booking platform, electronic form or mobile application, shall constitute acceptance of these Terms and Conditions and shall have the same force and effect as a handwritten signature.
